Last Updated: January 2025

Simma App account (“the Account”) is subject to the following Terms & Conditions:

Definitions and Interpretation

“Shipment” means all goods transported under one waybill (referred to as “Goods”, “Items”, “Products”) and may be transported by any method chosen by Simma, including: air or land transport or any other means of transportation. Each Shipment is transported in accordance with the limited liability stated in this document.

“Air Carriage Convention” means whichever of the following conventions may apply:

A. The Convention for the Unification of Certain Rules for International Carriage by Air signed in Montreal on 28 May 1999;

B. Or the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed in Warsaw on 12 October 1929; whether in its unamended form or as amended by the Hague Protocol 1955—hereinafter the Guatemala City Protocol 1971—and/or by Additional Protocol No. 3 of the Montreal Convention 1975 and/or by Additional Protocol No. 4 of the Montreal Convention 1975.

“Dangerous Goods” means a Shipment that contains harmful, dangerous, flammable, explosive, offensive (including radioactive) materials, or is likely to contain harmful, dangerous, flammable, explosive, offensive, radioactive materials, or materials that may cause harm to any person or property; whether specified by law or otherwise.

“Goods”, “Items” mean any goods or products that are the subject of the service provided to you by Simma under these Terms & Conditions.

“Government Authorities” means, for example: all government or quasi-government departments and entities responsible for importing and exporting goods and collecting revenues related to importing, exporting, and transporting goods.

Services

The user of the Simma application can browse and shop from international stores on the app. The user must enter the store displayed on the app from which they intend to purchase and add all items to the shopping cart in order to purchase them.

Registration for the Service and Authorizing Simma as Your Agent

To register for the service, you must complete the Simma registration request (“Registration Request”) and create an account on the app. Registration for the service is available to individuals aged 18 years or older. By registering for our service, you declare that you are an adult and 18 years of age or older; accordingly, you authorize Simma as your agent to receive, organize the transport process of your parcels, and deliver them.

Receipt and Delivery

The service provided by Simma includes purchasing the goods selected by the user from the stores available on our app/website and shipping them to Iraq, and transporting them to the user’s delivery address.

You alone are responsible for specifying and confirming the correct “Delivery Address” and your full information. Please note that any incorrect information may result in non-delivery, delayed delivery, or additional fees under this third clause, which you will be charged for. Any Shipment that cannot be delivered to you (for reasons including, for example: your failure to pay fees for a previous Shipment, or failure to receive the Shipment within 14 days even if its partial or full value was paid in advance, or failure to provide proper instructions; including: failing to provide a clear address for delivery, failing to update your Delivery Address, or inability to contact you after multiple attempts) will be considered uncollected or unclaimed goods, and Simma has the right to handle such Shipment in any lawful manner it deems appropriate; this may mean disposing of the Shipment, destroying it, returning it to the sender, or selling it at public auction.

The shipper (“third party and/or international stores”) is solely responsible for packaging your Shipment. Simma bears no responsibility for damage to the packaging if the Shipment itself is not damaged, and Simma is not obligated to re-package any Shipment for any reason. However, if both the packaging and the Shipment are damaged, Simma will compensate you in the manner it deems appropriate.

Inspection

Simma has the right—without assuming any liability—to open and inspect all requested goods for any reason determined by the company.

3. Service Restriction

Simma has the right not to purchase any item at any time after accepting it if it is among the goods not permitted by the company or if it is likely to cause damage or delay to other goods/shipments, equipment, or employees, or when such transport is prohibited by law or violates any clause of these Terms & Conditions.

Account Fees and Shipping Fees

You agree to pay all shipping fees and other expenses, including customs fees (if applicable) on imported goods for any Shipment ordered under your Account before receiving the Shipment. The Shipment will not be delivered if fees are not paid when Simma requests you to do so—regardless of the person who placed the order.

There are large-size Shipments that are subject to additional shipping fees. If your Shipment is classified as large in size or heavy in weight, an additional shipping fee will apply, and you must decide within (2) days whether you want to proceed with shipping or not.

Goods subject to additional shipping:

  1. Household electrical appliances

  2. Furniture of all kinds

  3. Car accessories

  4. Animal feed

  5. Home furniture

The additional shipping amount is determined based on size and weight by contacting customer service before purchase. A text message including the additional shipping amount will be sent, and the user must approve it so we can complete the order process.

Payment Options

Cash on Delivery: You will be contacted when the Shipment arrives and is out for delivery by the delivery company. The full amount due is paid to the delivery company and the Shipments are delivered, including customs fees on imported goods (if applicable) and any other fees that were paid.

If any of the fees communicated to you are not paid and/or the Shipment is not received within fourteen (14) days, you authorize us to treat any Shipment belonging to you as uncollected goods even if its partial or full value was paid in advance.

Payment via Simma Wallet:

The wallet payment policy of Simma applies. A copy of the privacy policy is available at the following link:

Amendment of Terms & Conditions, Services, and Fees

Simma may, at its sole discretion, add, change, or update these Terms & Conditions in whole from time to time without notifying you. All amendments are published on Simma’s website (www.simma.io) and become effective from the date of publication. You should review these Terms & Conditions periodically to remain compliant. Your use of the Account or application for services after any amendment constitutes your acceptance of these Terms & Conditions and your agreement to be bound by those changes/amendments. To view amendments or updates, please check the website from time to time, as Simma will not be responsible to compensate you for any damage if you do not do so.

Simma may amend shipping fees and all other related fees stated—or incidentally mentioned—in this document, as well as the Terms & Conditions at any time at its sole discretion, without prior notice. If you terminate the service, you will not be able to recover the paid amount. Simma may also change shipping frequency at any time without prior notice.

Termination of Service

You agree that Simma may terminate these Terms & Conditions for any valid reason at any time without notifying you. Valid reasons include, for example:

A. Using the Account for illegal, obscene, fraudulent purposes, or any purpose prohibited by Simma or the specified Simma website, or other systems;

B. Failure to pay amounts due to Simma when due;

C. Violation of any clause of these Terms & Conditions or clauses related to business rules and policies published by Simma on the website (www.simma.io).

You may close your Account on the app at any time, but you undertake in that case not to use the app or order any item through it after closing your Account. Simma may prevent you from using the app and ordering through it immediately after you close the Account. You undertake to pay the full amount due to the company before closing the Account; if not, Simma has the right to take any legal action it deems appropriate against you.

To determine a valid reason for termination of these Terms & Conditions, you acknowledge that the actions of any person authorized by you to use your Account or service will be attributed to you.

General Provisions

Simma may dispose of your goods, destroy them, donate them, or sell them at public auction within: (1) fourteen (14) days of attempting to contact the user and the user not receiving the Shipment; (2) shipments under an inactive Account; (3) non-payment of all applicable fees; (4) if the user information and/or address is incorrect. Notwithstanding the foregoing, Simma may destroy any pornographic materials or products and all other related contents of any kind immediately upon arrival at its warehouses.

You should review these Terms & Conditions periodically to remain compliant. To view amendments or updates, please check the website from time to time, as Simma will not be responsible to compensate you for any damage if you do not do so.

Simma’s failure at any time to enforce any phrase, ruling, or condition of these Terms & Conditions or to exercise any right contained herein shall not in any way be deemed a waiver.

Any dispute arising under or connected in any way with these Terms & Conditions shall— in favor of Simma—be subject to the non-exclusive jurisdiction of the courts of Amman, Jordan (Central Amman Court – Palace of Justice) and governed by its laws, and litigation shall be brought before those courts unless this conflicts with applicable law.

It is hereby acknowledged that this Simma Account registration agreement is made between Al-Nuqat Al-Mutasila for Information Technology LLC (referred to as “Simma”, “we”, “the Company”) and the individual or entity specified in the Simma voucher account subscription request (referred to as “the user”, “you”). This service is provided to you under these Terms & Conditions—and any updates or amendments—and the relevant business rules and policies published from time to time by Al-Nuqat Al-Mutasila for Information Technology on Simma’s website (www.simma.io).

Simma may, at its sole discretion, add, change, or update these Terms & Conditions in whole from time to time without notifying you. All amendments are published on Simma’s website (www.simma.io) and become effective from the date of publication.

If the Terms & Conditions contained in this document are not complied with, the company will give the user 14 days to use the available wallet balance; after that period, the company has the right to close the user’s Account and terminate the service and will not be responsible to compensate the user for any remaining balance or any damage.

(1) Terms & Conditions of Simma Shopping Vouchers

Simma shopping voucher account (“the Account”) is subject to the following Terms & Conditions:

Wallet: means an electronic balance used in online financial transactions through smartphones and topped up with cash.

Balance: means the cash amount topped up and available in the wallet within the Simma app.

Shopping Vouchers: a prepaid card purchased from Simma and used to buy goods through the Simma app.

When the balance is topped up, any additional features (if available and/or applied by Simma) such as points or additional balance or free shipping are activated immediately.

If the shopping vouchers are used and the balance is topped up, cash cannot be refunded; the cash will remain available in the balance on the app until it is used for purchases.

No person may transfer the topped-up balance in the wallet from one account (phone number) to another person’s account (another phone number).

The topped-up balance can only be used for shopping through the Simma app.

The validity of the topped-up balance in the app is one year from the date of top-up. As for shopping vouchers that are not topped up, they have an expiry date printed on them and must be topped up before the expiry date.

If the validity of the unused topped-up balance in the wallet expires or the validity of untopped-up shopping vouchers expires, the company has the right to dispose of the remaining unused balance in the wallet and the untopped-up vouchers as it wishes, and the user’s right to claim the topped-up or untopped-up amount lapses.

The topped-up balance in the wallet can be reused after expiry only if the balance is topped up again with a valid, unexpired shopping voucher.

Not all goods to be shipped fall under “free shipping” even if a free shipping campaign is announced or the user has a free shipping voucher in the wallet.

Goods subject to additional shipping cost:

  1. Household electrical appliances

  2. Furniture of all kinds

  3. Car accessories

  4. Animal feed

  5. Home furniture

If your goods are classified as large in size or heavy in weight, an additional shipping fee will apply, and you must decide within (2) days whether you want to proceed with shipping or not.

The additional shipping amount is determined based on size and weight by contacting customer service before purchase. The user must approve it for us to complete the order process.

Payment cannot be split across more than one method. For example, paying half in cash and the other half using shopping vouchers is not available at this time, and this service may be enabled in the future.

The user must link the phone number to the email registered on the app in order to access the wallet if they lose the ability to log in via phone number.

If the user cannot access the wallet via phone, they will be asked for the email to verify identity. Therefore, the person must create an account via email and link it to the phone number. If the company is unable to verify identity, it has the right to deal with the wallet as it wishes and as it deems appropriate, and the user’s right to claim the balance available in the wallet lapses.

If problems are encountered when topping up shopping vouchers, they must be kept and customer service contacted via the phone number on them, or the company email support@simma.io, or through the company’s social media channels.

In some cases beyond the company’s control, SMS messages (OTP via phone) may not be received when confirming the order for any reason. If that happens, the user is requested to try ordering again later when the service is reactivated.

The currency used in the app and shopping vouchers is Iraqi Dinar, and a currency exchange difference will be shown in the app according to the current market exchange rate.

When purchasing and receiving a new shopping voucher, the user must ensure the voucher is new and unused and that the scratch area is not scratched; if it is scratched, they must refuse to receive it.

If the user receives a scratched voucher and realizes later and wants to replace it, and the company determines it is already topped up, the company has the right to act as it wishes, refuse replacement, and proceed as it deems appropriate.

The user purchases goods and/or items from a third party through the Simma app; therefore, the company is not responsible for the user’s personal choices of goods/items (for example: item color, size, length, fabric type…).

The order cannot be canceled and cash refunded if the order status changes to “Order Confirmed” in the app.

(2) This Simma Account registration agreement is made between Al-Nuqat Al-Mutasila for Information Technology LLC (“Simma”, “we”, “the Company”) and the individual or entity specified in the Simma shopping voucher account subscription request (“the user”, “you”). Your use of Simma shopping vouchers (“the service”, “the app”, “the shopping vouchers”) is subject to these Terms & Conditions. The service is provided under these Terms & Conditions and any updates or amendments and the relevant business rules and policies published from time to time on Simma’s website (www.simma.io).

(3) Simma may, at its sole discretion, add, change, or update these Terms & Conditions in whole from time to time without notifying you. All amendments are published on Simma’s website (www.simma.io) and become effective from the date of publication.

(4) Simma may modify the additional balance and/or number of free shipping coupons and/or number of points granted on shopping vouchers or any other related fees stated—or incidentally mentioned—in this document, as well as the Terms & Conditions at any time at its sole discretion, without prior notice. If you terminate the service and/or close the Account, you will not be able to recover the available balance or the amount paid for the shopping vouchers. You are fully responsible for using the available balance (if any) before closing the Account and/or terminating the service. The company is not responsible for that and has the right to deal with the wallet and/or balance after termination/closure as it wishes and as it deems appropriate, and your right to claim the available wallet balance (if any) lapses.

(5) Account Suspension and Termination

Right to ban and retain:

We, Simma, reserve the right, at our absolute discretion, to freeze or hold your digital wallet account and any funds therein in any of the following cases:

  • Suspected or confirmed fraudulent activity related to your Account.

  • Misuse of the digital wallet service in violation of these Terms & Conditions.

  • Any action related to your Account that harms the reputation or image of our company, its employees, or customers.

We will make reasonable efforts to inform you before freezing or holding your Account unless we determine that immediate action is necessary to protect ourselves or our customers or others from harm.

In the case of suspected fraud, we may cooperate with law enforcement officials in their investigations.

During the period in which your Account is frozen or held, you may be restricted or fully prohibited from accessing the funds in your Account or using the digital wallet service.

We will determine the duration of the freeze or hold based on the specific circumstances and the course of any investigation.

We may permanently terminate and close your Account in cases of serious or repeated violations.

Your obligations:

  • You agree to cooperate with any investigation we may conduct regarding suspected fraud or misuse of your Account.

  • You are responsible for maintaining the confidentiality and security of your login credentials and any activity that occurs within your Account.

By using our digital wallet service, you acknowledge and agree to the terms stated in this paragraph.

(6) You should review these Terms & Conditions periodically to remain compliant. Your use of the subscription or Account or applying for services after any amendment constitutes your acceptance and agreement to be bound by those changes/amendments. To view amendments or updates, please check the website from time to time, as Simma will not be responsible to compensate you for any damage if you do not do so.

(7) Simma’s failure at any time to enforce any phrase, ruling, or condition of these Terms & Conditions or to exercise any right contained herein shall not in any way be deemed a waiver.

(8) Any dispute arising under or connected in any way with these Terms & Conditions shall—in favor of Simma—be subject to the non-exclusive jurisdiction of the courts of Amman, Jordan (Central Amman Court – Palace of Justice) and governed by its laws, and litigation shall be brought before those courts unless this conflicts with applicable law.

(9) If these Terms & Conditions are not complied with, the company will give the user 14 days to use the available wallet balance; after that period, the company has the right to close the user’s Account and terminate the service and will not be responsible to compensate the user for any remaining balance or any damage.

🟩 BNPL (Buy Now Pay Later) Terms & Conditions — Iraqi Market

Last updated: October 2025

These Terms & Conditions (“Terms”) govern how the Buy Now Pay Later (BNPL) service (“Service”) is used, provided by Simma in partnership with Tamara, for eligible customers in the Republic of Iraq. By using this Service, you agree to these Terms in addition to Simma’s general Terms of Use and Privacy Policy.

1. Eligibility

You must be at least 18 years old and hold a valid Iraqi national ID.

You must receive your salary through an account at National Bank of Iraq (NBI) or any participating approved bank.

BNPL is available for personal purchases only—commercial use or resale is not permitted.

Each customer may have only one active installment plan at any time. A new BNPL request may be submitted only after all installments of the previous plan have been fully paid.

2. Order Value and Installment Limits

BNPL is available only for orders between 150,000 IQD and 300,000 IQD.

Each BNPL plan is split into a maximum of two equal installments, each representing 50% of the total order value.

Orders outside this range are not eligible for BNPL financing.

3. Payment Schedule

The payment schedule depends on the order submission date:

If the order is submitted on or before the 21st of the month:

  • The first installment will be deducted upon receipt of the current month’s salary.

  • The second installment will be deducted 30 days after the first installment date.

If the order is submitted after the 21st of the month:

  • The first installment will be deducted upon receipt of the next month’s salary.

  • The second installment will be deducted 30 days after the first installment date.

Exact dates will appear in the in-app payment schedule or in the order confirmation message.

You authorize Simma and its banking partners to automatically deduct each installment from your salary upon receipt.

4. Late Installments and Default

If your salary is not detected by the 4th day of the month in which payment is due, the installment will be considered late.

Late installments may lead to:

  • Temporary account suspension until full payment is made;

  • Non-payment of overdue amounts may make the remaining balance immediately due.

Continued delay may result in permanent ineligibility to use BNPL services.

5. Plan Completion

A BNPL plan is considered completed once both installments (50% each) are paid and payment is confirmed.

After completion, you become eligible to submit a new BNPL request, subject to continued eligibility checks.

6. Refunds

If a BNPL order is canceled or refunded, the refunded amount will be credited exclusively to your Simma Wallet.

Refunds will not be transferred to NBI or any other bank account.

Wallet funds can be used for future purchases or withdrawn according to the Wallet Terms & Conditions.

7. Identity Verification and Data Processing

To comply with KYC and AML/CFT requirements of the Central Bank of Iraq (CBI), a valid Iraqi national ID must be provided when creating an account or activating BNPL.

The ID and related information will be used only for verification purposes and will not be shared or used for any other purpose.

The ID record will be permanently deleted within 12 months of the last successful payment (defined as the date of paying the final BNPL installment), unless the law requires longer retention for audit or compliance purposes.

All data is encrypted, stored securely, and processed in accordance with the Iraqi Personal Data Protection Draft Law and the Central Bank of Iraq IT Security Framework.

8. Responsible Use

You are responsible for ensuring sufficient funds are available in your account on installment due dates.

You agree not to misuse BNPL for investment or high-risk purchases.

Simma reserves the right to suspend or revoke BNPL access if misuse, fraud, or risky behavior is detected that conflicts with CBI consumer protection and responsible lending principles.

9. Legal Disclosure and Compliance

BNPL operates under the Central Bank of Iraq framework for deferred payments and consumer credit.

These Terms comply with:

  • Anti-Money Laundering and Counter-Terrorism Financing Law No. 39 of 2015

  • Central Bank Instruction No. 9 of 2020 (KYC and customer verification)

  • CBI Consumer Protection Principles 2023

  • Iraqi Personal Data Protection Draft Law

In case of any conflict between these Terms and applicable laws, applicable laws shall prevail.

10. Contact and Support
