Terms of use for Simma vouchers

General Terms and Conditions:

Account:

The Simma shopping vouchers account (“Account”) is subject to the following terms and conditions.

Wallet:

An electronic balance used for online financial transactions via smartphones and recharged with cash.

Balance:

The cash amount loaded and available in the wallet within the Simma application.

Shopping Vouchers:

Prepaid cards purchased from Simma and used to buy goods through the Simma application.

Upon recharging the balance, any additional features (if available or applied by Simma), such as points, bonus balance, or free shipping, will be activated immediately.

After using shopping vouchers and recharging the balance, cash refunds are not allowed; the cash remains available as balance in the application until it is used for purchases.

The recharged balance cannot be transferred from one account (phone number) to another account (another phone number).

The recharged balance can only be used for shopping through the Simma application.

The validity of the recharged balance in the application is one year from the date of recharge. Unloaded shopping vouchers have an expiration date and must be loaded before it expires.

If the unused recharged balance or unloaded shopping vouchers expire, the company has the right to dispose of the remaining unused balance and unloaded shopping vouchers as it sees fit, and the user forfeits the right to claim the recharged or unrecharged amount.

The recharged balance in the wallet may only be reused after its expiration if it is recharged again using a valid shopping voucher.

Not all products are eligible for “free shipping,” even if a free shipping campaign is announced or the user has a free shipping voucher.

Products subject to additional shipping fees include:

  • Home electrical appliances

  • Bedding and linens

  • Car accessories

  • Animal feed

  • Home furniture

If the products are large in size or heavy in weight, additional shipping fees will apply, and the user must decide within two days whether to proceed with shipping or not.

The additional shipping fee is determined based on size and weight through communication with customer service before completing the purchase, and the user must approve it to proceed with the order.

Splitting the payment of an order across more than one payment method is currently not available. This feature may be enabled in the future.

The user must link the phone number with the email registered in the application to access the wallet in case access via the phone number is lost.

If the user is unable to access the wallet via the phone number, the email address will be requested to confirm identity. The user must create an account using the email and link it to the phone number. If the company is unable to verify the identity, it has the right to dispose of the wallet as it sees fit, and the user forfeits the right to claim the available wallet balance.

In case of issues with loading shopping vouchers, the vouchers must be retained and customer service contacted via phone, email at support@simma.io, or through social media channels.

In some cases beyond the company’s control, SMS messages (OTP) may not be received during registration, password reset, or wallet payment. Please try again later once the service is restored.

The currency used within the application and shopping vouchers is the Iraqi Dinar, and the exchange rate difference will be displayed within the application in accordance with the current market exchange rate.

Upon purchasing and receiving a new shopping voucher, the user must ensure that it is new and unused and that the scratch area is intact. If the scratch area is damaged, the voucher must be refused.

If the user receives a scratched voucher and later realizes this and requests a replacement, and it is found by the company to be loaded, the company has the right to act as it sees fit and refuse replacement.

The user purchases goods from a third party through the Simma application; therefore, the company is not responsible for the user’s personal choices of goods (such as color, size, or type).

An order cannot be canceled and cash cannot be refunded once the order status changes to “Order Confirmed” in the application.


2. Account Agreement:

The Simma account registration agreement is entered into between Connected Points for Information Technology (“Simma,” “we,” “us,” or “the Company”) and the individual or entity identified in the Simma shopping vouchers account subscription request (“User,” “you,” or “your”). Your use of the Simma shopping vouchers service (“Service,” “Application,” “Shopping Vouchers”) is subject to these terms and conditions. The service is provided to you under these terms and conditions and any updates or amendments thereto, and related rules and operating policies published from time to time by Connected Points for Information Technology on Simma’s website (www.simma.io).


3. Amendments to Terms and Conditions:

Simma may add, change, or update these terms and conditions at its sole discretion from time to time without notifying you. All amendments are published on Simma’s website (www.simma.io) and become effective from the date of publication.


4. Modification of Bonus Balance and Vouchers:

Simma may modify the bonus balance, number of free shipping vouchers, number of awarded points on shopping vouchers, or any other related fees at any time at its sole discretion and without prior notice. In the event of service termination or account closure, you will not be able to recover the available balance or the amount paid for shopping vouchers. You are responsible for using the available balance before account cancellation or service termination. The company has the right to dispose of the wallet or balance after service termination or account closure as it sees fit, and your right to claim the wallet balance is forfeited.


5. Account Suspension and Termination:

Right to Block and Retain:

We reserve the right, at our sole discretion, to freeze or hold your digital wallet account and any funds therein in the event of:

  • Suspected or confirmed fraudulent activity

  • Misuse of the digital wallet service in violation of the terms and conditions

  • Any action that harms the reputation or image of the company, its employees, or its customers

We will make reasonable efforts to notify you before freezing or holding your account unless we determine that immediate action is necessary to protect ourselves, our customers, or others from harm.

In cases of suspected fraud, we may cooperate with law enforcement authorities in their investigations.

During the freeze or hold period, you may be restricted or completely prevented from accessing the funds in your account or using the digital wallet service.

The duration of the freeze or hold will be determined based on the specific circumstances and the course of the investigation.

We may permanently terminate and close your account in cases of serious or repeated violations.

Your Obligations:

You agree to cooperate with any investigation we conduct regarding suspected fraud or misuse of your account.

You are responsible for maintaining the confidentiality and security of your login credentials and for any activity that occurs within your account.

By using the digital wallet service, you acknowledge and agree to the terms set forth in this section.


6. Review of Terms and Conditions:

You should review these terms and conditions periodically to remain compliant. Your continued use of the subscription, account, or submission of a request for these services after any amendment constitutes your acceptance of such changes. To review updates or amendments, please visit the website from time to time, as the company shall not be liable to compensate you for any damage resulting from your failure to do so.


7. No Waiver:

Simma’s failure at any time to enforce any provision, condition, or exercise any right shall not be considered a waiver of such provision or right.


8. Jurisdiction:

Any dispute arising under these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of Amman, Jordan (Central Amman Court – Palace of Justice) and shall be governed by its laws, unless this conflicts with applicable law.


9. Non-Compliance:

In the event of non-compliance with the terms and conditions, the company will grant the user 14 days to use the available wallet balance. After this period, the company has the right to close the account and terminate the service without being responsible for compensating the user for any remaining balance or any damage.
